Should I trademark my instagram handle?

Just as one would expect, the answer coming from a lawyer is: it depends. There are many things to consider when deciding whether your handle needs the protection that a trademark provides. Let’s discuss a few of the most important issues here.

First, is your handle your business name? This makes all the difference when applying for your trademark. If you use a different business name than your handle, it may be time to reconsider and attempt to create a more cohesive, consistent business presence. When I am referring to your “business” this includes the business of being a social media entrepreneur. Whether you are an influencer, a blogger, a content creator or define yourself in some other way - what you are doing to earn a living is most certainly a business.
